TERMS OF USE
I/We certify that we will not now, nor anytime in the future, use this mailing list
for commercial purposes, copy this mailing list, use any portion to establish a
new list or as a basis for correcting and/or supplementing any other list, in
whole or in part.
I/We further certify that we will never now or in the future allow any of this
mailing list to be examined, loaned, copied, sold, duplicated or used for any
purpose.
I/We understand and acknowledge that this mailing list includes fictitious
names and addresses to monitor the use of the mailing list. I/We further
understand that this has been done to enable BecomeHealthyNow.com, Inc. (the
owner of the list) to detect any unauthorized use of this mailing list.
I/We agree to pay BecomeHealthyNow.com, Inc. a rental fee of $5 per name and
address, for each individual name and address I/we use for each and every
unauthorized use of this mailing list as referenced above. I/We specifically
agree, acknowledge and stipulate that the $5 per name and address fee set
forth herein represents a good faith effort, in light of the facts and
circumstances known at this time, to approximate and recover the annual cost
to BecomeHealthyNow.com, Inc. to prepare, compile, update and verify this list and
that the $5 fee is a reasonable liquidated damage pursuant to Florida. I/We further agree, acknowledge and stipulate that this list is
unique and requires substantial effort by BecomeHealthyNow.com, Inc. to prepare,
update, verify and compile and that BecomeHealthyNow.com, Inc. shall be entitled to
injunctive relief to bar and prohibit me/us from any further unauthorized usage
of the list.
I/We agree that this agreement shall be governed by the laws of the State of
Florida. Should any litigation be forthcoming, I/we mutually and specifically
agree that any and all litigation shall be tried in the Superior Court, County of
Pinellas, State of Florida. I/We agree that in the event of any controversy or
dispute arising out of this agreement, the prevailing party or parties shall be
entitled to recover from the non-prevailing party or parties reasonable
expenses, including, without limitation, attorney's fees and costs actually
incurred.
